Terms and conditions of sale

Article 1: Scope

These terms and conditions of sale (T&Cs) apply to any order placed on the ma-broche.fr website with SAS NanaMod (hereinafter "Ma Broche"). Any order implies full and unreserved acceptance of these T&Cs. The customer declares that they are of legal age and have the capacity to contract.

Article 2: Products

Ma Broche sells brooches, jewellery and accessories. The essential characteristics of each item (materials, dimensions, fastening) are shown on the product page. Photographs are as accurate as possible but cannot bind Ma Broche in the event of slight variations in colour or finish.

Article 3: Prices

Prices are shown in euros, all taxes included, excluding shipping costs. Shipping costs are specified before the order is confirmed and on the Shipping page. Shipping is free from €39 in France, Belgium and Luxembourg, and from €69 in the rest of the European Union. Ma Broche reserves the right to change its prices at any time, the applicable price being the one in force at the time of the order.

Article 4: Order

The customer selects the items, adds them to the basket, then confirms the order after checking its content. The sale becomes final after payment confirmation and the sending of a confirmation email. Ma Broche reserves the right to cancel any order in the event of a payment dispute or suspected fraud.

Article 5: Payment

Payment is made online, at the time of the order, by bank card or any other means offered at checkout, via our secure provider Mollie. Bank details are encrypted and are never stored by Ma Broche.

Article 6: Delivery

Orders confirmed before 2pm on business days are shipped the same day. Delivery times and areas served are detailed on the Shipping page. An email containing the tracking number is sent to the customer as soon as the order is shipped.

Article 7: Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal, without having to give a reason. The procedure is described on the Returns and refunds page. The refund, including standard shipping costs, is made within 14 days of the items being returned or proof of their return shipment.

Article 8: Legal guarantees

All products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a non-compliant or defective product, the customer may obtain the replacement or refund of the item free of charge.

Article 9: Returns and refunds

Items must be returned in their original condition, unworn and in their packaging. Return costs are borne by the customer, except in the event of an error by Ma Broche or a defective product. Full terms are set out on the Returns and refunds page.

Article 10: Personal data

The data collected is necessary to process orders. Its processing is described in our privacy policy, which complies with the GDPR.

Article 11: Intellectual property

All elements of the website (text, images, trademarks, logos) are protected and remain the property of SAS NanaMod. Any unauthorised use is prohibited.

Article 12: Applicable law and mediation

These T&Cs are subject to French law. In the event of a dispute, the customer shall first contact Ma Broche's customer service in order to seek an amicable solution. Failing this, they may use, free of charge, the European online dispute resolution platform: ec.europa.eu/consumers/odr. Failing an amicable settlement, the French courts shall have sole jurisdiction.
